Terms and conditions

This agreement describes the general terms and conditions (the “General Terms and Conditions”) applicable to the use of the services offered by Quinientos Quirós & Familia SA (“the Services”), within www.coffee-506.com (coffee-506.com or the “site”). Any person (hereinafter “User”) who wishes to access and / or use the site or services may do so by being subject to the General Terms and Conditions, together with all other policies and principles that govern coffee-506.com and which are incorporated here as a reference.

ANY PERSON WHO DOES NOT ACCEPT THESE GENERAL TERMS AND CONDITIONS, WHICH HAVE A MANDATORY AND BINDING CHARACTER, SHALL NOT BE ABLE TO USE THE SITE AND / OR THE SERVICES.

The User must read, understand and accept all the conditions established in the General Terms and Conditions and in the Privacy Policies, as well as in other documents incorporated to them by reference, prior to registering as a User of coffee-506.com

Capability

Services are only available to people with legal capability to hire. The services may not be used by people who do not have that capability, minors or coffee-506.com users who have been temporarily suspended or permanently disabled. If you are registering a User as a Company, you must be able to hire on behalf of such entity and bind it under the terms of this agreement.

Registration

It is mandatory to complete all the fields in the registration form with valid data to be able to use the services provided by coffee-506.com. The future User must complete the registration form with his / her personal information in an accurately, precise and truly manner (“Personal Data”) and undertakes to update Personal Data as necessary. Coffee-506.com may use various means to identify its Users, but coffee-506.com is NOT responsible for the certainty of the Personal Data provided by its Users. The Users guarantee and respond, in any case, the truthfulness, accuracy, validity and authenticity of the Personal Data entered.

Coffee-506.com reserves the right to request additional proof and / or data in order to corroborate the Personal Data, as well as to temporarily or definitively suspend those Users whose data can not be confirmed. In these cases of disqualification, all items selected or requested by the user, as well as the offers made, will be discharged without generating any right to compensation.

The User will access his personal account (“Account”) by entering his User and personal security key chosen (“Security Key”). The User undertakes to maintain the confidentiality of his Security Key.

The Account is personal, unique and non-transferable, and it is prohibited for the same User to register or have more than one Account. In the case that coffee-506.com detects different Accounts that contain coincident or related data, they can cancel, suspend or disable the accounts.

The User will be responsible for all operations carried out on his Account, since the access to it is restricted to the entry and use of his Security Key, for the User’s exclusive knowledge. The User undertakes to notify coffee-506.com immediately and through appropriate and reliable means, any unauthorized use of his Account, as well as the entry by unauthorized third parties. It is hereby clarified that the sale, assignment or transfer of the Account (including reputation and qualifications) under any title is prohibited.

coffee-506.com reserves the right to reject any application for registration or to cancel a previously accepted registration, without it being forced to communicate or explain the reasons for its decision and without it generating any right to compensation or compensation.

Coffee Acquisition

coffee-506 can cancel the customer´s order if the payment method is invalid or if the purchased product is not in the site´s inventory, in both cases the customer will be contacted up to 3 times through the mail and phone numbers provided, if we do not receive any response, we will not be responsible and we will terminate the Order, the User will be deemed to accept the terms described herein.

Agreement modifications

Coffee-506.com may modify the General Terms and Conditions at any time by posting the modified terms on the Site. All modified terms will take effect within 10 (ten) days of publication. The User must communicate through e-mail by clicking on servicio@coffee-506.com within 5 (five) days following the publication of the modifications introduced, if he does not accept the same; in that case the contractual link will be dissolved and will be disabled as a User. Upon expiration of this term, the User will be deemed to accept the new terms and the contract will continue to bind both parties.

Personal Data Privacy

In order to use the Services offered by coffee-506.com, Users must provide certain personal data. Your personal information is processed and stored on servers or magnetic media that maintain high security standards and physical and technological protection.

User Obligations

The Buyer is obliged to attempt to communicate with the seller and complete the transaction if he has purchased a published item and for any other or different reasons the transaction is not completed. Unless the operation is prohibited by law or the General Terms and Conditions and other policies of coffee-506.com, in which case you will not be required to specify the operation.

By purchasing an item, the User agrees to be bound by the sale conditions included in the item´s description, insofar as they do not violate the laws, the General Terms and Conditions and other policies of coffee-506.com. The purchase offer is irrevocable except in exceptional circumstances, such as that the seller substantially changes the description of the article after a purchase has been made, that there is a clear typographical error, or that it can not verify the seller´s identity.

Purchases will only be considered valid once they have been processed by the coffee-506.com computer system and the respective back orders have been issued and confirmed.

Taxes

As established by current tax regulations, the buyer must demand an invoice or ticket from the seller as a proof of the transaction. Except for occasions and products established by law.

Prohibitions

Users will not be able to: (a) manipulate the items´ prices; (b) maintain any type of communication by e-mail, or by any other means with direct suppliers (c) disclose your personal or other users’ information by any means. (d) insulting or assaulting other Users or coworkers of coffee-506.com; (e) use your reputation, ratings, comments or replies received on the coffee-506.com site in any environment outside of coffee-506.com.

This type of activity will be investigated by coffee-506.com and the infringer may be sanctioned with the suspension or cancellation as a User of coffee-506.com.

System or Databases Violations

No action or use of a device, software, or other means is allowed to interfere in the coffee-506.com activities and operations, as well as in offers, descriptions, accounts or databases of coffee-506.com. Any interference, attempt or activity that violates or contraries the laws on intellectual property rights and / or the prohibitions stipulated in this contract will enable the person liable for the relevant legal actions, and the sanctions provided by this agreement, as well as responsible to compensate the damages caused.

Scope of coffee-506.com services

This agreement does not create any partnership, mandate, franchise, or employment relationship between coffee-506.com will not be responsible for the correspondence or contracts that the User enters into with such third parties or with other Users.

System failures

coffee-506.com is not responsible for any damage, harm or loss to the User caused by system, server or Internet failures. Coffee-506.com will not be responsible for any virus that could infect the User’s computer as a result of access, use or navigation of your website or any transfer of data, files, images, texts, or audio contained therein . Users can not impute any responsibility or demand payment for lost profits, under loss resulting from technical difficulties or failures in the systems or the Internet. Coffee-506.com does not guarantee the access and continuous or uninterrupted use of your site. The system may not be available due to technical difficulties or Internet failures, or for any other circumstances beyond coffee-506.com; in such cases, an attempt will be made to restore it as quickly as possible without any liability being imputed to it. Coffee-506.com shall not be liable for any errors or omissions contained in its website.

Rates and Billing

Registration at coffee-506.com is free. Coffee-506.com reserves the right to modify, change, add, or delete the current rates, at any time, which will be notified to the Users, in the established way on the registration form. However, coffee-506.com may temporarily modify the Rates Policy and the rates for its services by promotion reasons, these modifications being effective when the promotion is made public or the advertisement is made.

coffee-506.com reserves the right to take any judicial and extrajudicial measures deemed appropriate to obtain payment of the amount owed.

In the event that charges that should have not been applied were invoiced, the User should contact our Customer Service team to resolve said issue.

All information on these concerns will be published and will be considered an integral part of the General Terms and Conditions.

Delivery timeframes

We offer a delivery service to any part of the Costa Rican territory as well as abroad, as long as restrictions are not applied in certain cases.

For shipments within Costa Rica we will be using Courier EMS Services from Costa Rica´s Post Office, and DHL for shipments outside the country.

For delivery purposes, it is important that the customer always place his exact address in order to avoid any inconvenience when the merchandise is delivered. Correos de Costa Rica (Costa Rica´s Post Office), will always require that the address is accurate, as well as a valid phone number for the customer (cellphone preferably) to be able to contact the customer if necessary at the time of the product´s delivery.

The delivery time for all merchandise is from 1 to 5 business days.

Other countries: delivery time is from 8 to 10 business days. However, the term could be extended, since this service is subject to the time frames that will depend on the destination and country of the delivery, in conformity with DHL and the company in charge of delivering the package in their respective destination country.

It is important for our customers to take into consider that sometimes the delivery time could be affected, for reasons beyond our control. If this is the case, the customer is free to consult about his merchandise, and we are obliged to provide him with all the information about it.

All shipping costs will be detailed at the time that the customer confirms the purchase, they may vary according to the destination, size and weight of the item. All prices shown on our website are final and do not include the transfer of the product to Costa Rica, otherwise it will be made known to our customer in advanced when any product carries an extra charge other than those currently shown at the time of purchase, such as additional services and shipping costs.

The customer is RESPONSIBLE for providing the exact delivery address. All shipments will be made through Costa Rica´s Post Office to the address that the customer details on the payment confirmation form or invoice.

www.coffee-506.com is not responsable for any missing details that affect the merchandise´s delivery, so the customer should get in contact directly with the Costa Rica´s Post Office, with the tracking number provided previously.

Holidays

Coffee-506 will not work, nor deliver on the following holidays:

January 1st (New Year’s Day), April 11th (Juan Santamaría Day), Holy Thursday and Holy Friday, May 1st (International Labor Day), July 25th (Annexation of Nicoya´s Party to Costa Rica), August 15th (Mother’s Day and Assumption of the Virgin), September 15th (National Independence Day of Costa Rica), December 25th (Nativity of Jesus Christ), August 2nd (Virgin of Los Angeles´s Day) and October 12th (Columbus Day).

Cancellations

Any person can cancel their purchase prior to the product being delivered by sending an email to info@coffee-506.com stating their intention to cancel the purchase order and requesting a refund.

In case that the purchased item is not available due to a lack of stock, the customer will be notified with an explanation on why the order can not be delivered and the customer can decide if he wants to change, cancel or reinstate the purchase or cancel it in order to obtain a full refund of the money.

Returns

The customer will have 48 hours after the delivery has been made to coordinate with coffee-506.com the request for a refund of the money or change the product by sending an email to info@coffee-506.com, as long as the product is without use and in excellent conditions as delivered.

Terms Summary

Coffee-506.com will only gather information that is deemed relevant and necessary to understand the customers´ needs and to carry out its activities.

Coffee-506.com will use the customers´ information to provide them with the best service and the best products.

Coffee-506.com will not disclose customer´s information to any outside organization unless Coffee-506.com has the customer’s consent or if required by law or has previously informed the customer.

Coffee-506.com may occasionally be requested to disclose customer information to any governmental or judicial agency or agency, or to the Coffee-506.com regulators, but Coffee-506.com will only make such disclosure to the competent authority.

Coffee-506.com seeks to keep the customers’ information up-to-date.
